Legal Notice - Public Hearings for October 16, 2023


TO THE GENERAL PUBLIC AND PARTICULARLY THE CITIZENS OF THE CITY OF STATESVILLE’S PLANNING JURISDICTION YOU WILL TAKE NOTICE:

That the City Council of the City of Statesville will hold and conduct public hearings on the 16th day of October 2023, at 7:00 p.m. in the Council Chamber of City Hall, 227 South Center Street, Statesville, North Carolina, for the purpose of considering the proposed cases as follows:

Development Agreement for ZC23-01/ Statesville Gateway

Development Agreement for ZC23-01/Statesville Gateway: Planned Unit Development (PUD) Rezoning initiated by T. J. Pecorak for properties located on US 21 North (Turnersburg Highway). The rezoning was approved on August 7, 2023, by the Statesville City Council and includes commercial uses and townhomes. This request is to approve a development agreement that further establishes the permitted uses per the rezoning concept plan along with water and sewer extensions and upgrades, standards for public and private streets, open space sanitation service and a development schedule for 10 parcels totaling approximately 32.241 acres. The properties are further identified as Iredell County Tax Map #’s 4746-40-6187, 4746-41-5424, 4746-41-6753, 4746-41-4886, 4746-42-5269, 4746-42-5496, 4746-42-6636, 4746-42-6758, 4746-42-6982, and 4746-42-7865. A copy of the proposed “Development Agreement” is available for public inspection in the Planning Department located at 227 S. Center Street, Statesville, NC  28677.

Rezoning Request - 103 Serene Meadow Trail

ZC23-14: Rezoning initiated by the City of Statesville, for the property located at 103 Serene Meadow Trail, Statesville, NC from the Iredell County RA (Residential Agricultural) District and Troutman RS (Suburban Residential) to City of Statesville RA (Residential Agricultural) District. The request is to rezone approximately 16.13 acres to assign a City of Statesville zoning district to the property since it was annexed on February 28, 2021, to access city water; Tax Map Parcel # 4732-56-5223.

TA23-08: Text Amendments to the Unified Development Code filed by City of Statesville to amend Article 2. Development Review Process, Section 2.01 Application Process, Table 2-1: Summary of Application Procedure and Section 2.10 Special Use Permits, Article 3. Zoning, Section 3.04 Zoning District Regulations, I. R-8MF-Medium Density Multi-Family Residential District, L. R-5MF-High Density Multi-Family Residential District, M. O-1 – Office Single Lot District, N. O & I-2 – Office and Institutional District, O. B-1 – Neighborhood Service District, P. B-2 – Neighborhood Business District, Article 5. Supplemental Regulations/Performance Standards for Specific Uses, Section 5.04 Primary Uses and Structures, Z. Dwellings, Planned Multi-family Dwellings and Article 6. Development Standards, Section 6.02 Density and Dimensional Standards, B. Residential Density, 2. to clarify regulations for Duplexes, Townhomes and Multi-family in O-1, O & I-2, B-1, and B-2 Zoning Districts and increase the density for townhomes.

2019 Mobility + Development Plan Amendments

2019 Mobility + Development Plan Amendment: Request to remove proposed new street known as Berkshire Drive Extension which would extend the end of existing Berkshire Drive to Club Drive, filed by Statesville Select Properties, LLC.

2019 Mobility + Development Plan Amendment: Request to remove proposed new street known as James Farm Road Extension and flyover across Interstate 77 which would extend existing James Farm Road over I-77 to Crawford Road, filed by the City of Statesville.
